Pazzani & Sandhu Scores Appellate Victory in Student Discipline Case

Pazzani & Sandhu attorneys Karen Pazzani and Simar Ahluwalia notched a win in the California Court of Appeal, upholding the lower court’s decision denying a student’s petition for a writ of mandate. Agreeing with our client’s position, the Court of Appeal concluded that the university’s finding that the student cheated on an exam was supported by substantial evidence and the university appropriately followed its procedures in reaching this conclusion.

Pazzani & Sandhu Receives Top Verdict Honors

The Daily Journal recognized partner Karen Pazzani, along with co-counsel at Horvitz & Levy, on their California Supreme Court victory on behalf of the University of Southern California in Boermeester v. Carry. Ms. Pazzani represented the University from the inception of the case and, with appellate counsel, successfully obtained review from the California Supreme Court and persuaded the Court to disapprove a series of opinions that required an onerous process including live cross-examination when private universities investigate sexual assault and intimate partner violence.

Pazzani & Sandhu LLP Scores a Win in the California Supreme Court. On August 1, 2023, in Boermeester v. Carry, the California Supreme Court ruled that private universities are not required to allow live cross-examination of parties and witnesses in student disciplinary proceedings.
Partner Karen Pazzani represented the university involved in this matter in the Superior Court and Court of Appeal and was part of the legal team that represented the university in the California Supreme Court.
